I hereby present my monitoring report on Executive Limitation 1.0 in accordance with the monitoring schedule as set forth in board policy. The policy revision book used for this monitoring report is dated 10.12.07. I certify the information in this report is true.

EL 1.0 General Executive Constraint
 
The Superintendent shall not cause or allow any practice, activity or decision organizational circumstance that is unlawful, imprudent or in violation of commonly accepted business and professional ethics.
 
            Interpretation:
Practices, activities, decision or organizational circumstances may be "caused" or "allowed' by the failure to oversee and ensure compliance of the District’s standards for prudent action and correction of violations which are known to exist. Such standards are found in district policies and procedures and BOE executive limitations.
 
             I interpret "Unlawful" to mean:
Situations, which are determined to be illegal by a State of Colorado or federal agency, or by a court of law. Other unlawful situations are those about which the District knows and which are likely to be illegal based on persuasive judicial authority.
 
    Data:
       One legal violation of HIPPA for non-secured confidential benefits information
       One Office of Civil Rights Resolution Conference settlement
One violation of a charter school teacher out of compliance with the Highly Qualified criteria in NCLB
 
During this monitoring period of October1, 2006 to October 1, 2007, 100% of the known legal violations have been corrected.
 
I report Compliance
 
          
  I interpret "Imprudent" to mean:
Any situation, which violates Executive Limitations, or which otherwise, continues despite the fact that federal and state mandates or District policies require different action.
 
Data:
   One Policy violation for a professional legal contract over $25,000
43 out of 79 total annual vendor payments regarding contracts of expenditures over $150K did not receive BOE approval
9 out of 42 vendor payments over $25,000 in professional serviced did not receive Board approval
One violation of Colorado Department of Education revenue reporting compliance for student counts.
One identified wrong use of advertising at LSE
Access to inappropriate web content by employees and students in DCSD
RVMS hired one contractor to install classroom projectors without proper oversite
 
During this reporting period 100% of the imprudent violations have been corrected.
 
I report Compliance
 
 
I interpret "Commonly accepted business and professional ethics" to mean:
Compliance with the law and normative action that affirms how things ought to be. To determine what ought to be, since people reasonably disagree about many business and professional ethical issues, the ethics should be focused on the principle of service to others and the opportunity to allow a process of deliberation. The interaction in which the way the disputants relate to each other is as important as the questions of who has the right to make the decision that is “right” in the end.
 
    Data:
       Zero violations of ethics have been reported for correction.
